Federal law enforcement authorities have arrested and charged a Georgia investment broker and a Florida attorney in connection with orchestrating sophisticated, multi-year Ponzi schemes that allegedly defrauded unsuspecting investors of nearly $2 million. According to announcements made by the U.S. Attorney’s Office for the Northern District of Georgia, the fraudulent operations lured victims in by dangling the prospect of extraordinarily high financial returns, including promises that principal investments could multiply by as much as 16 times within remarkably short timeframes ranging from 30 to 90 days.
The federal grand jury indictment, which was officially returned on September 22nd, details how the elaborate financial fraud was allegedly executed over a four-year period. Prosecutors assert that Roosevelt Tobias “Toby” Bailey, a 70-year-old resident of Duluth, Georgia, spearheaded the fraudulent undertakings through his corporate entity, Borg Global. The deceptive activities reportedly spanned from approximately October 2018 through October 2022, targeting individuals seeking lucrative investment vehicles but ultimately resulting in substantial financial devastation for those who entrusted their savings to Bailey and his associates.
According to the official court documents, Bailey and his co-conspirator operated multiple fraudulent investment programs under the umbrella of Borg Global. The first of these deceptive offerings was designated as the Micro-Cap program. In pitching this program to prospective investors, Bailey allegedly promised to double their capital by pooling funds together to purchase precious stones and metals internationally. The narrative presented to victims was that these commodities would be acquired outside the United States and subsequently resold at a significantly higher profit margin within the domestic market, generating quick and reliable returns for all participants involved.
The second initiative, known as the Standby Letter of Credit program, featured even more astronomical financial enticements. Investors were allegedly promised that their capital would yield returns of up to 16 times their initial investment within a remarkably abbreviated window of 30 to 90 days. Such staggering figures are widely recognized by financial regulators as classic red flags indicative of high-risk fraud or outright Ponzi schemes, yet the allure of exponential wealth reportedly proved successful in convincing individuals to part with their hard-earned money.
Despite the grand promises made regarding international precious metals trading and specialized financial instruments, federal prosecutors allege that the incoming capital was never actually deployed into either the Micro-Cap program or the Standby Letter of Credit program. Instead, a comprehensive financial forensic analysis by investigators suggests that the investor funds were systematically diverted for entirely unauthorized purposes. The money allegedly flowed directly into Bailey’s personal bank accounts, as well as accounts associated with his business entities, to subsidize a lifestyle funded by fraud. Furthermore, investigators assert that a portion of the incoming funds was utilized to pay off earlier investors—a hallmark mechanism of a traditional Ponzi scheme designed to create the illusion of legitimate profitability and maintain the confidence of participants while encouraging further investments.
To facilitate the operation and lend an air of professional legitimacy to the proceedings, Bailey allegedly enlisted the assistance of Alvin Jones, a former prosecutor and practicing attorney based in Tampa, Florida. According to the federal indictment, Jones played a crucial role in the execution of the fraud by routing incoming investor funds through his law firm’s designated trust accounts before transferring the money to Bailey. In exchange for his participation in facilitating the financial transfers, Jones allegedly retained a portion of the illicitly obtained funds for his own personal and professional benefit. The involvement of a licensed attorney acting in an official capacity is believed to have played a significant role in lowering the guard of investors, who trusted that the funds were being securely held and managed within a protected legal framework.
The legal fallout culminated in separate arrest and arraignment proceedings for both defendants following the federal indictment. Bailey was taken into custody and formally arraigned on October 16th, while Jones was arrested and subsequently arraigned a few days later on October 20th. Within the federal court system, Bailey faces a substantial slate of serious criminal charges, including seven individual counts of wire fraud, one count of money laundering conspiracy, and three distinct counts of substantive money laundering. Meanwhile, Jones has been charged with one count of money laundering conspiracy and three counts of money laundering, reflecting his alleged role in handling and concealing the proceeds generated by the fraudulent investment vehicles.
The gravity of the alleged offenses was underscored by statements from federal law enforcement leadership. U.S. Attorney Theodore S. Hertzberg detailed the mechanics of the alleged deception during the public announcement of the charges, highlighting the abuse of professional trust that characterized the operation. Hertzberg stated that Bailey allegedly lured investors based on promises of massive returns and false assurances that their investments would be securely held in Jones’s trust accounts. However, rather than safeguarding that money as promised, Jones allegedly funneled the capital directly to Bailey while retaining a cut for himself, leaving trusting investors to bear the full brunt of their devastating financial losses.
The comprehensive investigation that led to the criminal charges was spearheaded by the Federal Bureau of Investigation, which received critical assistance and technical support from the U.S. Securities and Exchange Commission. The involvement of financial market regulators and federal law enforcement highlights the ongoing collaborative efforts to identify, investigate, and prosecute individuals who leverage complex corporate structures and professional credentials to perpetrate financial fraud against the public.
As the legal process moves forward, federal prosecutors and defense counsel will prepare for further court appearances and pretrial proceedings in the Northern District of Georgia. Consistent with the principles of the American legal system, the charges contained within the federal indictment are merely formal allegations, and both Roosevelt Tobias Bailey and Alvin Jones are presumed innocent until and unless proven guilty beyond a reasonable doubt in a court of law.
